Not all injuries that occur at work can be covered by workers’ compensation. Although, the majority of injuries are, there are still some exceptions that aren’t covered. Chances are if you are doing work for the benefit of the employer and you get hurt or sick on the job, your injury or illness is most likely work-related and you can receive benefits as long as you meet the eligibility requirements.
Often, injuries or illnesses that occur on lunch breaks or while traveling to and from work are not covered under workers’ compensation. For example. If an employee was walking to the local deli to pick up lunch and tripped over the sidewalk resulting in a sprained ankle, he/she could not be eligible to receive workers comp. If an employee sprained an ankle in a company cafeteria, then the injury might be covered by workers comp.
Lots of companies have company events, whether it be a bowling league, softball league or a company picnic; injuries can still occur. If the employee is required to attend the event, then chances are that the injury will be covered by workers comp. If it’s not a requirement for the employee to attend, then it’s a good idea to have them sign a waiver which clearly explains that the employee is participating in this event voluntarily and any injury that may occur is not covered by workers’ compensation.
Work place misconduct is a large reason to why workers get hurt in the first place. If a worker is breaking a workplace safety rule or was doing something prohibited by the employer, then the Work Comp carrier may be able to reduce the employee’s benefits. This is due to the violation or the company’s policy. Injuries suffered by a worker while committing a crime is absolutely not covered by workers compensation.
If a worker is injured outside of the workplace they are ineligible for workers comp. Injuries or illnesses have to be directly related to their employment to be considered for coverage under workers comp.
We can’t stress enough how important it is to always have workers compensation insurance. Even if you only have 1 employee, state laws require that you carry workers compensation. Failure to provide the required insurance can land you in big trouble. It is a class A misdemeanor with a penalty equal to 3 times the annual premium you would have paid. Also, fines up to $50k could be possible. This could really hurt your business and your reputation.
Postings of Notice
It is important to post information identifying your insurance carrier, designated medical provider and claim administrator. This is important because you might not always be on-site on when an accident occurs, and it is important to get the claim filed as soon as possible, within 24 hours if possible.
Immediate Medical Care
As an employer you must provide your injured employees with immediate medical care. If it’s an emergency dial 911 and have the employee make an appointment with your designated medical provider as soon as they are able. If it’s not an emergency then have them go directly to the designated medical provider.
The sooner you report a claim, the better. We suggest reporting the injury within 24 hours. This will allow your insurance carrier to get involved as soon as possible so the employee can receive proper treatment right away which will resolve the claim faster and get the employee back to work sooner.
Stay in Contact
Don’t let your injured employee go through the process alone; let them know you care and want them back to work as soon as they can. Keep in touch with them and help them keep their doctor’s appointments, help them arrange transportation to and from appointments if they are unable to drive. Be prepared to offer modified duty for injured workers based on the Doctor’s instructions.
A lot of people put professional athletes on pedestals. In fact I find myself doing it often as well. Especially with the 2014 Olympics recently ending, I found myself awing over the huge air the skiers/snowboarders get, the dangerous speeds that the luge athletes fly down in, and beautiful life or death spins the figure skaters do (I say life or death because could you imagine hitting your head on that ice? Ouch!). Either way, we are all guilty of remembering sometimes that professional athletes are just ordinary people, who deal with ordinary problems such as workers compensation.
Recently in the state of California, the state Governor, Jerry Brown, signed a new law into measure. The new law limits the ability of out-of-state professional athletes to file for workers’ compensation in the state of California. So for instance, if the Lakers gained a new player in a trade and that player got hurt only after a few games. he possibly could not be eligible to make a claim. The new law covers almost all professional sports in the state such as: baseball, basketball, football, ice hockey, and soccer.
Although the law was supported but the MLB, NBA, NFL, and NHL; there has been a backlash from pro athletes about the law. The players have been arguing that they are entitled to file workers’ comp claims regardless where their team is based because they pay income taxes for each game they play in the state. Athletes also accept workers’ comp as a benefit in their salary packages.

It’s that time again folks! Beer of the month! For those of you who don’t know, Colorado has a few notable towns, one being Boulder. Some call it the happiest city in America (according to a new NY Times ranking), others call it hippyville, and some consider it the just an ordinary college town. No matter what the collective view of the town is one thing is for sure: Boulder makes great beer! This month’s “beer of the month” comes straight out of Boulder, Colorado. Going by the name “Hazed and Infused” you can actually taste all the personalities of the town in the beer. With it’s unique taste one can’t help themselves but to be intrigued to drink more. Hazed and Infused is one of those beers that taste great but you can’t really put your finger on what it actually tastes like. That’s because the brewers at Boulder Beer Company have blended four different hop varieties together to give the beer that unique aroma. The beer is a dry-hopped ale. With it’s amber color and smooth taste it is easy to finish a bottle before you even know it!
Although it is 4.85% alcohol, which is a bit lower for a craft beer here in Colorado, a six pack tends to go quite quickly! It’s citrusy to the nose but has a huge hoppy kick once tasted! This beer tastes the best when drank out of a becker glass. What is also unique about this beer is that it goes fantastic with Thai dishes and dipping sauce. It also tastes great with any kind of spicy sushi!
This beer is definitely one to try. With it’s fruity smell and spring ski season flourishing up in the mountains right now, this is definitely a patio beer at the lodge on a ski day! So kick back, relax, take in the mountains, and sip away
An effective safety program instilled in a work environment can go a long way. Management’s involvement is key to creating an effective program. It is important to have a safety program because it reduces the extent and severity of work related injuries, improves employees morale and productivity, and over all reduces the costs of workers compensation. Some elements of an effective program are:
- Management commitment and employee involvement.
- Work site analysis.
- Hazard prevention and control.
- Safety and health training.
- regularly inspections of control hazards.
- orient and train all employees to eliminate or avoid hazards.
A good program goes beyond specific requirements of the law to address all hazards. Also, remember to review program operations at least annually to evaluate, identify deficiencies, and revise as needed.
Colorado’s workers compensation is a state mandated coverage for all (private and public) Colorado companies to cover employees’ lost wages and medical costs for all injuries that occur while working. A person who is hired to preform services for a company has to be covered by law. But, there are some exemptions:
- Certain casual maintenance or repair work performed for a business for under $2,000 per calendar year
- Certain domestic work, maintenance or repair work for a private homeowner that is not done full time
- Licensed real estate agents and brokers working on commission
- Independent contractors who perform specific for-hire transportation jobs
- Drivers under a lease agreement with a common or contract carrier
- Any person who volunteers time or services for a ski area operator
- Persons who provide host home services as part of residential services and supports
Likewise, Colorado business owners with no employees can fill out an opt out form to file in compliance, but if they later on decide to hire an employee they must make sure that employee is covered. In addition, companies that are based out of Colorado but have employees working in other states must abide by the Colorado law and have all their employees covered.
Premiums are based on the type of industry you are in and the payroll of all your employees. A company that engages in solely office work pays less than a company that does manual labor. This is because there is less chance of getting seriously injured sitting behind a desk than operating machines and doing construction work. But no matter what industry your company is in, accidents do happen and that’s why workers compensation is so important.
This is truly how I feel about my personal Journey. I am just an average Jane, married with two kids.
I started running about two years ago. There was no deep down desire to start running. I never dreamed of being an elite athlete. The deciding factor for choosing this sport was it is simple to run. I did not need to depend on anyone, I did not need a lot of expensive equipment, and I could look on the internet and see how to train.
I thought it would be really fun to do something “extraordinary” for my 40th birthday, so I trained and I ran the Horsetooth Half Marathon two years ago in April. It was probably the coolest thing I have ever done! The atmosphere was incredible. You had runners that would stand at the top of the hill and encourage us newby’s up the hill. When I ran across the finish line it was an emotional reaction. All that hard work paid off…
So fast forward two years. Last year the majority of my time was spent adjusting to being an empty nester. Our youngest daughter went into the Navy. Our oldest is married, has babies and lives in Nebraska. So to get out of the fog, I have decided this year that I want to run a marathon. This is what this blog is about. The ups and downs of this journey, and maybe get some people who were on the fence about a new exercise program. I will be touching on all aspects of marathon training including: eating tips, ideas on how to relieve muscle aches (IcyHot is my best friend EVER) and maybe get some ideas from other people who are reading this blog.
I hope you enjoy being a part of my training- I could use all the support I can get. After all I am not a trained athlete. I am just an average Jane.
This month we are featuring none other than the TommyKnocker’s Pick Axe IPA. Brewed at the TommyKnocker brewery in Idaho Springs, Colorado and containing a 6.2% alcohol volume, this beer will make you feel like you’re in the beautiful mountains of Colorado with every sip. The TommyKnocker brewery has been creating outstanding tastes since 1994. It’s a classic American India Pale Ale with a medium amber hue. Pick Axe has a mixture of tastes that all flow together to leave your mouth watering. It’s big sweet, fruity, citric taste has an underlaying pine edge which really highlights the hops in the drink. This beer goes great with spicy food. When I first tried TommyKnocker I was eating a basket of wings. But the beer will go well with anything that has a kick to it! It definitely clears the taste palate!
